Sandbox Terms and conditions

The Sandbox Terms of Use ("Terms of Use") are between you and Abstract-Technology GMBH ("Abstract") and apply the LMS that Abstract has provided you in order for you to access the Open edX LMS and the Open edX STUDIO in a standalone environment for testing purposes (the "Sandbox"). By accessing the Abstract-Technology Open edX Sandbox, you agree to these Terms of Use. If you do not agree to these Terms of Use, do not access the Sandbox.

Restricted Use

You agree to only use the Abstract-Technology Open edX Sandbox for testing purposes, excluding without limitation any production services. You acknowledge that Abstract may reset the Abstract-Technology Open edX Sandbox at any time in its sole discretion (every 24h).

Prohibited Use

In addition to your obligations under Section 1 (Restricted Use), you will not:

  • use the Abstract-Technology Open edX Sandbox for any commercial purposes;
  • share your access to the Abstract-Technology Open edX Sandbox with any third parties;
  • use the Abstract-Technology Open edX Sandbox to violate any law, statute or regulation applicable to you or Abstract;
  • use the Abstract-Technology Open edX Sandbox to cause harm to Abstract or any third parties;
  • access the Abstract-Technology Open edX Sandbox for the purpose of monitoring its availability, performance and functionality, or for any other benchmarking or competitive purposes;
  • transmit any virus, trojan horse, or other harmful code that may cause unauthorized access to, damage to, interfere with, or otherwise adversely affect the Abstract-Technology Open edX Sandbox;
  • Abstract-Technology Open edX Sandbox is using Open Source Software;

Prohibited Use

Abstract reverses all intellectual property rights, titles and interests in the Abstract-Technology Open edX Sandbox. No rights in the Sandbox are granted to you other than those included in these Terms of Use.

As Is” Warranty; Disclaimer of Warranties

The Abstract-Technology Open edX Sandbox is provided “as is” and on an “as available basis. Abstract does not warrant that the Sandbox is error free or uninterrupted. Except for the warranties and representations that are expressly set forth in these Terms of Service, Abstract makes nor representation or warranty of any kind, express, implined, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purposes, suitability, title, non-infringement, or claim of right or any warranties or obligations arising from course of dealing, usage, or trade practice, and all such representation and warranties and obligation are hereby disclaimed.

The Abstract-Technology Open edX Sandbox may contain errors or inaccuracies that could cause failures, including without limitation, loss or corruption or data from the Abstract-Technology Open edX Sandbox and/or servers, computers, or other hardware connected there to. Abstract is not obligated to provide any maintenance, technical, or other support for th Abstract-Technology Open edX Sandbox. Any activities that you perform using or accessing the Abstract-Technology Open edX Sandbox are at your own risk.

Content data

We are not responsible for your content residing on the LMS. In no event shall we be held liable for any loss of any Content. Every day, at 6AM CEST, the instance is refreshed and all data is removed.

User content

We do not own any data, information or material (collectively, “Content”) that you submit on the LMS in the course of using the Service. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted content. Data sent to the Sandbox platform is deleted every day. Do not send sensitive or personal data to the platform.

Without limiting any of those representations or warranties, we have the right, though not the obligation, to, in our own sole discretion, refuse or remove any content that, in our reasonable opinion, violates any of our policies or is in any way harmful or objectionable. Unless specifically permitted by you, your use of the LMS does not grant us the license to use, reproduce, adapt, modify, publish or distribute the content created by you or stored in your user account for commercial, marketing or any similar purpose.

Information we collect

When you register for an Account, we may ask for your contact information, including items such as name and email address.

How we use your information

We use the information we collect in various ways, including to:

  • Provide, operate, and maintain our LMS
  • Improve, personalize, and expand our LMS
  • Understand and analyze how you use the Sandbox

Communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the LMS, and for marketing and promotional purposes.

Cookie Policy – Technical cookies

We only use technical cookies to enable you to use our LMS, to facilitate the navigation, to provide you with a better LMS experience and to identify problems in order to improve the Sandbox.

Indemnification

You agree to indemnify and hold harmless Abstract-Technology, its managing directors, shareholders, and representatives (collectively “Personnel”), its affiliates, and their Personnel (all the aforementioned, “Abstract Parties”) against loss, liability, claims, damages or expenses (including attorney’s fees) related to your breach of these Terms of Service.

Compliance with Applicable Laws

You must ensure to use the Software in compliance with the applicable laws, regulations and with the applicable industry best practice standards.

General Terms

Abstract may modify or amend these Terms of Use at any time in its sole discretion and shall notify you by updating the “Last Updated” date located at the top of these Terms of Use. These Terms of Use create no agency or partnership or joint venture or employment relationship between you and Abstract. These Terms of Use and any disputes or matters arising from or relating to or in connection with the subject matter hereof shall be governed and construed by the laws of the Germany (without regard to conflict of laws principles).

These Terms of Use constitutes the entire agreement between you and Abstract pertaining to its subject matter and supersedes all prior and other contemporaneous agreements, representations, warranties and understandings between you and Abstract, whether written or oral or express or implied.
